Wrongful Death
When an individual is killed from wrongful death actions, often it is due to the negligence or misconduct of another individual, company or entity. Under Oregon Revised Statute 30.020, a civil statute that establishes the procedures for bringing wrongful death actions to court, settlements belongs to the estate and is normally brought by the personal representative of the estate. For example, actions for personal injury, conscious pain and suffering, or expenses incurred prior to the decedent’s death are examples of compensation that can be brought by the personal representative. The damage awards from these actions belong to the estate and may pass to different parties as directed by the decedent’s will or state probate succession law.
